Investigation Concerning Termination of Smokers And/Or Charging Smokers Higher Healthcare or Disability Premiums. In 30 states and the District of Columbia, state law makes it illegal for companies to impose smoking bans on their employees when they are off duty. In addition, the federal employee benefits law, ERISA, prevents employers from discriminating against and/or firing employees, here smokers, to interfere with the attainment of any right under a benefit plan, here the right to health benefits. Smoking bans crossing line of common sense. The anti-smoking campaign has crossed the line toward infringing on individual rights. Smoking products are still legal. Used Smoke. There is a philosophy that I call Conform and Obey or Pay. History writers have given this philosophy different names but the outcome is the same. The bottom line of this philosophy negates a free country and a free people. Do you want to be free or not?

We refer to bars and restaurants as “public” places because people go there, but they are actually privately owned businesses. If there were a demand for smoke-free establishments, then owners would ban the practice voluntarily — as many already have. Some have not, indicating the demand for places where smoking is permitted, but those bothered by secondhand smoke are free to avoid the latter. Better to live with risk than limit our choices.
